Selecting a Mediator
Derby Community Mediation Services maintains a panel of mediators. The panels consists of volunteer and paid mediators. At times these may be consultant mediators. Wherever possible, Derby Community Mediation Services will provide a Mediator with the skills to deal with the particular issue at hand.
Professional Liability Indemnity Insurance
When a mediation takes place the mediation service is supplied by the mediator (or, where the mediator is a member of a firm or company, that firm or company). The appropriate body, therefore, to take out professional liability insurance, is the mediator (or his/her firm or company).
Derby Community Mediation Services maintains its own professional liability insurance in respect of the administration of mediations and associated tasks.
Derby Community Mediation Services conducts periodic checks to ascertain that Derby Community Mediation Services mediators carry current professional liability insurance but Derby Community Mediation Services cannot and does not warrant that any particular mediator (or his/her firm or company) is insured at any particular time.
The onus is on the parties and their advisers to satisfy themselves that the professional liability insurance carried by the mediator selected is sufficient and appropriate for the relevant dispute.
